Privacy Policy

Last revised April 4th, 2016

Who we are

This site is operated by Tilting Motor Works, Inc. (“TMW”). This privacy policy applies to the practices of TMW with respect to the information it collects about you online at its Web sites, including https://tiltingmotorworks.com.

Please note that TMW’s Web sites are located in the United States and TMW may collect, store and process your personal information in the United States or in other countries outside of the country in which you live. The United States and/or these countries may not offer a level of privacy protection for your personal information as great as is offered in the country in which you live.

The information we collect

TMW collects your Personal Information (“PI”) if you visit our Web sites and wish to register, purchase products, obtain information regarding one of our products or services, enroll as a member in our communities, request other information (e.g., investor information), or otherwise communicate with us about our offerings. PI means any information relating to a natural person who can be identified, directly or indirectly, from that information by reference to an identification number or to one or more factors specific to his or her physical, physiological, mental, economic, cultural or social identity. The PI we collect about you can include name, address, telephone number, e-mail address, credit card number and expiration date, password, preferred dealer, purchase history, IP address, what Web sites you come from, which pages you visit at this Web site, and information about online activities that are directly linked to them. This information may be merged with other information TMW already knows, such as whether you are the owner of a TMW-equipped motorcycle, or information available from other sources such as credit card verification and credit services and dealers.

How we use the information

TMW will collect and use your PI to render services to you; respond to your inquiries; market and sell products, programs, and services offered by TMW; and market and sell to you TMW products, programs, and services offered by its dealers and business alliance companies. In addition, TMW may use PI to conduct other legitimate business activities, such as protecting the security of the Web sites and of TMW’s networks, guarding against potential liability, engaging in debt collection, responding to a court order or subpoena, preventing fraud, complying with law, and complying with a legally permitted inquiry by a government agency or regulator.

If necessary for the purposes mentioned above, TMW may transfer your PI to third parties and these third parties may use your PI for such purposes. These third parties may include TMW’s dealers, advisors, companies providing products and services (such as IT systems suppliers) to TMW and, to the extent required by law, regulatory authorities (including tax authorities). TMW also may transfer your PI to its business alliance companies that have entered into a contract with TMW to offer, endorse, or sponsor a TMW product, program, or service.

If the version of this Web site you are using allows you to purchase products or services online, your PI will be used to complete any transactions you wish to enter into, including credit card processing and credit checks. Your name, address, e-mail address, telephone number and, where applicable, credit card information and purchase details, will be shared with any participating TMW dealer who fulfills your order. Please note that TMW dealers are independent from TMW. However, participating dealers are not to use PI submitted in connection with an order made through this Web site for any purpose other than the purposes identified above.

TMW selects its partners carefully and requires third parties to whom we transfer your PI to use your PI only within the context of their agreement(s) with TMW, and only for the purposes stated above, including direct marketing of products or services to you. However, TMW does not audit the activities of its partners and is unable to control their use of your PI. You should contact these third parties directly if you have any questions or concerns regarding their use of your PI.

TMW will not share, sell or rent your PI to unaffiliated third parties, or to affiliated parties for any purpose other than those listed above. In the event that all or any part of the TMW corporate family is sold to a third party, we may transfer your PI to the third party buyer as part of the assets of the business and that entity’s privacy policies may differ from TMW’s.

We may share anonymous aggregated demographic and general trend information with any third party we choose.

Your choices

You may request, at any time, that the PI you provide on the Registration page or when updating your profile not be used to contact you for direct marketing purposes by tiltingmotorworks.com, or transferred by tiltingmotorworks.com to third parties for marketing purposes, by clicking on the Unsubscribe link in any direct marketing email you receive from TMW.

Unsubscribing will not remove your PI from other TMW programs in which you may have enrolled through TMW’s Web sites or from other lists maintained by TMW. Nor will it remove your PI from lists maintained by TMW dealers (including dealers who received your PI to fulfill your online purchases), rental operators, business alliance companies, and persons and companies providing services to TMW. You should contact these third parties directly if you have any questions or concerns regarding their use of your PI.

Our use of “cookies” and other computer information

As is the case with many sites, when you visit our site and complete a registration form, we will save a “cookie” on your computer, which helps us identify you more quickly when you return. Cookies are small pieces of information stored by your browser on your computer’s hard drive and are used in website system administration to keep track of movement of a computer user from one screen to another or from one session to the next. We will use “cookies” alone or in conjunction with other devices described below, to understand how you arrived at our Web sites, to determine which pages or information you find most useful or interesting at our own Web sites, and to make choices about how to deliver the most relevant marketing messages about our products to you. This information may also be used by our staff to detect and resolve Web site problems and to assist with customer support concerns.

Most Web browsers automatically accept cookies, but you can usually change your browser settings to prevent acceptance of a cookie offered by a Web site. If you experience any problems using our website, please contact us at Tilting Motor Works, Inc., 2175 W 2nd Ave, Eugene, Oregon 97402, Attention: eMarketing Dept., or e-mail us at info@tiltingmotorworks.com.

We also use transparent GIF files, or pixel tags, and similar technologies to help manage online advertising. These files, which are provided by our third party ad management partners, enable our ad management partners to recognize a unique cookie on your Web browser. This, in turn, allows our ad management partners to provide us with data concerning visitors’ activities on our site, track and measure the performance of our marketing efforts and assist in the delivery of relevant marketing messages. These technologies are placed by us, or by another third party who works with our ad management partners to provide these services. With both cookies and pixel tag technology, the information that we collect and share is anonymous and not personally identifiable. It does not contain your name, address, telephone number, or e-mail address. For more information about advertising networks, including information about how to opt out of these technologies, click here, https://www.networkadvertising.org/consumer/opt_out.asp.

Our approach to data security

To prevent unauthorized access to your PI, we have put in place physical, electronic, and managerial procedures (including Secured Socket Layer technology for credit card transactions). We will use various electronic means to keep transaction information transferred over the Web as secure as generally available transaction technology reasonably permits.

Our commitment to children’s privacy

We recognize the importance of protecting the privacy of children. For this reason, we do not collect or maintain information from children we know are under 13 except as permitted by law.

Collection of information by third parties

Our Web pages may offer promotions that are sponsored by or co-sponsored with identified third parties. By virtue of their sponsorship, these third parties may obtain PI that visitors voluntarily submit to participate in the activity. We have no control over these third parties’ use of this information and we encourage you to consult their privacy policies for more information on their privacy practices.

In addition, you should be aware that the issuer of your credit cad may also independently collect information about your online purchase. We have no control over these third parties’ use of information. You should consult you credit card issuer’s privacy policy for more information on its privacy practices.

Links

To improve your Web experience, and to offer you products in which you might be interested, we may provide links to business alliance companies, TMW dealers, and other third-party sites. When you click on one of these links, you will be transferred out of our Web site and connected to the Web site of the organization or company that you selected. Because TMW does not control these sites (even if an affiliation exists between our Web sites and a third party site), you are encouraged to review their individual privacy notices. If you visit a Web site that is linked to our sites, you should consult that site’s privacy policy before providing any PI.

Changes in practices

This Privacy Policy may change from time to time, and any changes will be posted here. If we materially change our privacy practices to permit us to share more information about you than we stated we would share, or to permit disclosures of information about you to additional types of parties, we will take reasonable measures to inform you of these changes in advance. You will then have a reasonable opportunity to change your opt-out preference.
